How to Establish Authorship in the Era of Generative AI: Tools and Legal Challenges

A key risk for creators and businesses is increasingly not that generative AI “creates instead of humans.” The real issue is different: human creative contribution does exist, but it is becoming difficult to prove in the event of a dispute — with a client, platform, partner, or competitor.

Traditional methods of proving authorship — publication date, source files, or correspondence — are increasingly insufficient. Generative models blur the boundaries between creation, editing, and automated generation. As a result, documenting authorship has become a separate legal and managerial challenge.
